
Smoke
On a homeowners policy ho3 form, smoke includes the emission or puffback of smoke, soot, fumes, or vapors from a boiler, furnace, or related equipment. In order for coverage to apply, the smoke must be sudden and accidental. For example, if the furnace in the insured’s house malfunctions and it suddenly emits large amounts of smoke into the house, coverage is provided. But if the insureds both smoke two packs of cigarettes a day in the home for many years, any smoke damage this causes to their personal property is excluded.
Smoke losses from agricultural smudging or industrial operations are excluded. This type of loss is not seen as sudden and accidental, since these are normally ongoing, purposeful operations.
